1. Who We Are

Sketch To (the "Service", "we", "us") is operated by HACK THINKING LAB LTD, a limited company registered in England and Wales. Sketch To is an AI-powered image generation and editing platform available at https://www.sketchto.com.

2. Acceptance of Terms

By accessing or using the Service, you agree to these Terms of Service ("Terms"), our Privacy Policy, and our Acceptable Use Policy. If you do not agree, do not use the Service.

We may update these Terms from time to time. Material changes will be communicated through the Service. Continued use after changes take effect constitutes acceptance.

3. Eligibility and Age Requirement

You must be at least 18 years old to create an account or use the Service. By using the Service you represent and warrant that you are 18 or older. We may suspend or terminate any account that we believe is operated by a person under 18.

4. Account Registration

1. Account creation. You agree to provide accurate, current, and complete information during registration and to keep it up to date.
2. Account security. You are responsible for safeguarding your credentials and for all activity under your account.
3. One person, one account. Creating multiple accounts to evade enforcement, abuse free credits, or circumvent restrictions is prohibited.

5. Acceptable Use

Your use of the Service is governed by our Acceptable Use Policy, which is incorporated by reference. In particular, and without limiting the AUP, you must not use the Service to generate, upload, store, or distribute:

• Sexually explicit, pornographic, or other adult content;
• Any depiction of a minor in a sexualised context (including stylised, anime, "loli", or otherwise — strictly prohibited and reportable);
• Non-consensual intimate imagery, including "undress", "nudify", or similar deepfake transformations of identifiable individuals;
• Imagery designed to impersonate, defame, or harass a real person;
• Content that infringes copyright, trademark, or other intellectual property rights;
• Content that is unlawful, fraudulent, deceptive, or threatening.

We use a combination of automated moderation and manual review to enforce this policy.

6. Enforcement

If we determine, in our sole discretion, that you have breached these Terms or the AUP, we may:

• Block prompts, refuse generations, or remove content without notice;
• Suspend or permanently terminate your account;
• Forfeit any unused credits without refund;
• Retain abuse audit records (account ID, hashed prompt, timestamps) as needed to investigate, respond to law enforcement, or comply with legal obligations;
• Report illegal content (including any suspected child sexual abuse material) to the appropriate authorities, including the National Center for Missing & Exploited Children (NCMEC), the UK National Crime Agency, or other competent bodies.

We do not provide refunds for accounts terminated under this section.

7. User Content and Licence

• Your content. You retain ownership of images you upload and the AI-generated outputs you create through the Service, subject to the rights of any third parties depicted and any restrictions imposed by the underlying AI model providers.
• Licence to us. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, transmit, process, and display your content solely to operate, secure, and improve the Service.
• Removal. We may remove or disable any content that we believe violates these Terms, the AUP, applicable law, or third-party rights, with or without notice.

8. Intellectual Property

The Service, including its software, models, branding, and design, is owned by HACK THINKING LAB LTD and its licensors and is protected by intellectual property laws. You may not reverse engineer, decompile, scrape, or attempt to extract the underlying models or systems.

9. Credits, Pricing, and Payments

• The Service operates on a credit-based system. Credit prices and the credit cost of each operation are displayed at the point of purchase.
• New users may receive a complimentary trial allocation. Trial credits are non-transferable.
• All purchases are processed by third-party payment providers (such as Stripe). You authorise the payment provider to charge the amount displayed at checkout.
• All credit purchases are final and non-refundable, except where required by applicable law or where we issue a refund at our sole discretion.
• Failed generations caused by content moderation (for example, prompts blocked under the AUP) do not entitle you to a refund.

10. Third-Party Services

The Service relies on third-party AI providers and infrastructure (for example, Replicate, Cloudflare, and Stripe). Your use of those providers may be subject to their own terms and privacy policies. We are not responsible for their availability, performance, or actions.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any specific output will be produced.

12. Limitation of Liability

To the fullest extent permitted by law, HACK THINKING LAB LTD and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising out of or in connection with your use of the Service. Our aggregate liability for any direct damages shall not exceed the greater of (a) the amount you paid to us in the twelve (12) months preceding the claim, or (b) USD 50.

13. Indemnity

You agree to indemnify and hold harmless HACK THINKING LAB LTD and its affiliates from any claims, damages, losses, liabilities, and reasonable expenses (including legal fees) arising from your content, your use of the Service, or your breach of these Terms or the AUP.

14. Termination

You may stop using the Service at any time. We may suspend or terminate your access at any time for any reason, including suspected breach of these Terms. Sections 6, 7, 8, 11, 12, 13, 14, 15, and 16 survive termination.

15. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Subject to any mandatory consumer protection laws applicable to you, the courts of England and Wales shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Service.
